To Silicone or not?

I did an air test on a property today that had siliconed the skirting boards to the chipboard 6 months ago. The problem is they have had a bit of settling as you would expect, and it is seperating and the air from the envelope is entering the house as cold air now.

I wonder if the short term measure solution for air tightness is not being recognised in the long term?

I notice at my own house where I have siliconed the skirting boards in the bathroom to the oak floor, the silicone is seperating a bit and I will have to do it again even after only 6 months.  I suspect that the better solution is addressing this at the build stage with approved details as the source of plans to make things right.
